Pablo Picasso, Abraham Lincoln, and Jimi Hendrix, all died without a Will, and given their respective assets and family connections made dealing with their estates when they died far more complicated than they needed to be.


It is estimated that in England and Wales more than 2/3rds of the adult population die without a Will, and even with the most straightforward of assets can make for significant problems.


Without a Will the first potential issue is “who will actually take control and deal with the distribution of assets?”. With a Will this question is answered by the appointment of an Executor, but without it the rules of intestacy dictate who will be the relevant person.

It is worth reminding that the intestacy rules originate from the 1850s with the occasional update over the decades, and needless to say the family unit of over a century ago doesn’t resemble what it looks like in 2024! Also remember there is no legal definition of cohabitation, and what may be viewed as a “common law spouse” has no legal foundation either.


Having a professionally drawn Will in place will address who should benefit and what the tax implications are as certain estates can be subject to paying tax – and some may not be considering the nature of assets left and available tax exemptions.


Making a Will can be extremely emotive and is a personal decision which must and should not be taken lightly and can even be quite upsetting considering what is involved. However, there is undoubted peace of mind once the process has been completed – why would you not want to do it at all and leave matters to arbitrary rules created two centuries ago!
