Can I make a claim if I think the work accident was my fault?
Many people who have accidents at work think it is just perhaps bad luck or poor judgement on their part that caused the accident. They may even think they are partly or fully to blame. Women especially are more likely not to claim for injuries caused by an accident at work, with approximately only 3% of claims being from female workplace injuries.
It is always best policy to take legal advice in these circumstances as in many cases employers are ultimately responsible for removing risks so that employees never feel they have to take them.

Will I lose my job if I make a personal injury claim against my employer?
This concern frequently prevents employees who have been hurt whilst at work from making a claim. However, if you are in doubt as to whether you should claim the following points may help you make a decision:
- Your employer should have insurance to pay compensation to injured people.
- Whilst the claim for compensation is sent first to your employer, after that it will be dealt with by their insurance company and your solicitor. Afterwards your employer will have little (if any) involvement in the case.
- As an employee you have rights to prevent you from being treated unfairly or sacked. If your employer fires you because you have started or are contemplating making a personal injury claim, you may be able to claim for unfair dismissal.
- If you are sacked you may be able to claim loss of earnings in compensation for the accident.
- It is not inevitable that all of your colleagues or managers will find out about your claim. Personal injury claims are, and tend to remain, confidential.
- Ask yourself, would your employer make a claim if the roles were reversed?
