Family Law: Co-habitation Agreements, Pre-Nutial Agreements and Post-Nuptial Agreements

18th Jun 2025 Family Law: Co-habitation Agreements, Pre-Nutial Agreements and Post-Nuptial Agreements

Weddings are a joyful time for individuals, and it can feel uncomfortable and off the mark at this special time between you and your partner to think about an agreement in relation to finances. However, by entering into one of the below agreements, you can ensure security and financial transparency to help protect your future.

Pre-nuptial agreements – thinking of getting married?

Whilst you are planning your big day, you may be worried about a potential disparity in wealth between yourself and your partner. By entering into a Pre-nuptial agreement, you can protect not just your individual assets but family assets, such as a trust in a property or a business which has passed from generation to generation prior to your marriage.

Alternatively, if this is not your first marriage, you may want to ensure that your children from a previous marriage are protected and preserve certain assets for their future.

Post-nuptial agreements – already married?… it’s not too late

Sometimes individuals may miss the chance or feel it is not the right time to enter into a Pre-nuptial. However, it is never too late, as a post-nuptial agreement can facilitate the same needs as a pre-nuptial agreement, only after marriage.

Cohabitation Agreement – for those who are not intending to marry

This is a written agreement between two individuals who are living together but are unmarried. This document can set out arrangements for finances, property and child arrangements. This can provide protection for you both and your families should you go your separate ways in the future.
