How long will the divorce process take?

A divorce can take anywhere between approximately 6-9 months to complete. Following the divorce application and the acknowledgment by the other party, you will be placed into what is known as a “20 week holding/cooling off period”. Essentially, this time allows the parties to agree the financial division of the matrimonial assets, whether this be via agreement, mediation, through solicitors or otherwise.

It is advised that the Applicant does not apply for the Final Order (thereby formally ending the marriage) until such time as financial matters are approved by the Court. For assistance in relation to this, please contact our family team.

What is the process to get divorced?

The divorce process is completed online and can be accessed via the GOV.UK website at Get a divorce: How to apply – GOV.UK. The Court fee is £612. If matters are amicable, it is often suggested that this fee is split 50:50 between the parties.

My Spouse has started divorce proceedings – what happens now?

If your Spouse has applied for a divorce, they will be regarded as the Applicant during the Proceedings.

As the other party, you will be regarded as the Respondent. You will receive an acknowledgement of service form from the Court. It is advised that you complete this form and return it to the Court at your earliest opportunity to help prevent delay.

Do I need to obtain my Spouses’ agreement to the divorce and can they contest?

You will not require your Spouse’s agreement to file for a divorce.

Since April 2022, all UK divorces are now dealt with on a “no fault” basis and either party can apply.

It is extremely rare for an individual to be successful in contesting a divorce. In only extreme circumstances where an individual’s actions have had such a life changing impact on a person will the Court consider an individual’s behaviour or actions during the process of divorce.
