What is Personal Injury and what types of personal injury are there?

Personal injury is often caused by the negligence or action (or sometimes inaction) of someone else. Basically, someone causes you to get hurt when they could have stopped it.

Examples of the types of accident we usually see are:

  1. Work accidents at factories where equipment malfunctions
  2. Public liability accidents where someone has tripped and fallen on faulty slabbing or potholes.
  3. Accidents whilst visiting a premises such as a shop; these usually involve slipping on something on the floor, falling down poorly lit stairs, tripping over aisle hazards, etc.
  4. Motoring accidents, where the other party was driving in a negligent way and caused a collision with another vehicle, cyclist or pedestrian.
  5. Medical negligence; where a health issue has been misdiagnosed or a treatment has left you feeling much worse than you had before.

I don’t know if the accident was my fault, or partly my fault. Can I still claim?

Honesty really is the best policy when coming to us for a free meeting to discuss how you had gotten hurt and the extent of the injuries you have suffered.

We assess each individual case based on the facts we are provided and provide ‘no win, no fee’ funding as standard to provide financial security and peace of mind to injured claimants.

If the accident was your fault, you likely will not have a claim, however if you were partly to blame you may still be able to make a claim where final compensation will be reduced by a percentage to reflect your ‘contributory negligence’ towards the accident occurring.

An example of contributory negligence is where a driver is injured in a car accident, but was not wearing their seatbelt, meaning injuries were much worse than they could have been.

If you are not sure, or you want a second opinion, we are happy to have a chat. Even if it seems there is likely no prospects of a successful claim, for peace of mind it is always good to double check with us.
