The rise in the number of home-made Wills together with unregulated and unqualified will writing companies has led to a record number of Wills being contested by aggrieved relatives.

More than a third (36%) of people aged over 55 have yet to make a Will according to a survey carried out.  By not making a Will, close family members or dependents may not be automatically entitled to inherit under the Intestacy Rules, which are the Government’s rules of who inherits. It is also important to make it clear that there is currently no legal definition of cohabitation and no automatic entitlement by a partner under the Intestacy Rules.
